All content on the website is duly protected by intellectual and industrial property regulations, and is registered in the corresponding public registries.

Regardless of the purpose for which they were intended, total or partial reproduction, use, exploitation, distribution and marketing require, in any case, prior written authorisation from the CONTROLLER. Any use not authorised in advance is considered a serious breach of the author's intellectual or industrial property rights.

3.1. Main characteristics of the goods and/or services

The main characteristics of the goods and/or services offered through the Website can be consulted on the descriptive sheet itself with which they are presented.

 

3.2. Purchasing procedure

The language in which the contracting may be formalised is Spanish and Catalan.

The procedure for purchasing goods and/or services through the Website is as follows:

  1. Once on the product and/or service page, the User can choose from the options offered, where applicable (quantity, size, etc.). To continue with the purchasing process, the User must click on the button labelled “Add to basket”.

  2. Once the User has added all the desired goods and/or services to their basket, they can access it and view them all. At this point, the User can modify the desired quantity of any good and/or service, apply a discount coupon (if they have one) and leave a note regarding their order. To continue with the purchase process, the User must click on the button labelled “Checkout”.

  3. Next, the User must provide the details marked as mandatory (*) and select a payment method from those available. If the User has already registered previously on the Website, they may log in at this point. To continue with the purchase process, the User must click on the button labelled “Complete purchase”.

  4. Next, the User will view the total amount to be paid and the selected payment method. To continue with the purchasing process, the User must click on the button labelled “Pay”.

  5. Finally, the User will see an on-screen message confirming the successful completion of the purchase process. MAC AMBIENTS will store electronic proof of the contract entered into by the User, who will be able to consult their purchase history made through their account. In the event that the contracted good or service is not available, MAC AMBIENTS will immediately inform the User of this lack of availability, giving them the option to recover without delay any amounts they may have already paid.

  6. Password. The User is responsible at all times for the custody of their password and consequently assumes any damage or loss that may derive from its improper use, as well as its transfer, disclosure or loss. For these purposes, access to restricted areas and/or the use of the services and contents of the Website carried out with their password shall be deemed to have been made by the User.

  7. Correction and identification of errors in data entry. When the User forgets to correctly complete any data indicated as mandatory in the corresponding form, they will not be able to proceed with the contracting or validation process until they have filled it in. An on-screen message will warn them of this circumstance. They may modify and/or update the details provided during the purchase process at any time before its completion by going back to the desired step. By accessing their account, the User may modify and/or update the details they provided at the time of registering as a user of the Website at any time.

4. DELIVERY OF ORDERS

All delivery times provided by MAC AMBIENTS refer to working days, excluding weekends and bank holidays. MAC AMBIENTS does not make shipments outside of Spain or to the Canary Islands, Ceuta and Melilla.

For products in the category cushions, duvets, covers, bedding, the delivery time is between 2 and 12 working days.

For mattress products, the delivery time is between 7 and 15 working days.

Various products are delivered within 24/48 hours. The product page indicates when delivery is within 24/48 hours.

 

5. PRICE, PAYMENT METHODS AND SHIPPING COSTS

The prices indicated for each good and/or service on its corresponding product page include, unless expressly stated otherwise, Value Added Tax (VAT) and, in any case, are expressed by default in euros (€). These prices, unless expressly stated otherwise, do not include shipping costs, shipping insurance or any other additional and ancillary service related to the purchased good or service.

The payment methods available on the Website are as follows:

  • CREDIT / DEBIT CARD.

  • Bizum.

  • PayPal.

  • KLARNA.

Deliveries are made through the transport/courier providers contracted by MAC AMBIENTS.

Shipping costs

Free delivery on orders to the Spanish mainland over €50. The delivery charge for purchases under €50 is €6.

Deliveries are made to the ground floor; goods are not taken upstairs.

 

6. RIGHT OF WITHDRAWAL

The user has the right to withdraw from the contract entered into with MAC AMBIENTS within a period of thirty calendar days without the need for justification, without prejudice to the exceptions to the right of withdrawal indicated below.

The cancellation period will expire after thirty calendar days calculated from:

  1. In the case of a service contract: from the day the contract is concluded.

  2. In the case of a sales contract: from the day on which the User, or a third party indicated by them other than the carrier, acquires physical possession of the goods.

  3. In the case of multiple goods ordered by the User in a single order and delivered separately: from the day on which the User or a third party indicated by them, other than the carrier, acquires physical possession of the last of the goods.

  4. In the event of the delivery of a good consisting of multiple components or parts: from the day on which the User or a third party indicated by them, other than the carrier, acquires physical possession of the last component or part.

To exercise the right of withdrawal, the User must notify MAC AMBIENTS of their decision to withdraw from the contract by means of an unequivocal statement (for example, a letter sent by post or email). The User may use the model withdrawal form set out below, although its use is not mandatory.

To meet the cancellation deadline, it is sufficient for the communication concerning your exercise of this right to be sent before the period expires thirty calendar days.

Consequences of withdrawal

In the event of withdrawal by the User, MAC AMBIENTS shall refund to the User all payments received, including delivery charges, with the exception of the additional costs resulting from the User's choice of a delivery method other than the least expensive standard delivery method offered by MAC AMBIENTS, without undue delay and, in any event, no later than within the period of 14 calendar days from the date on which MAC AMBIENTS is informed of the User's decision to withdraw from the contract.

MAC AMBIENTS will make this refund using the same payment method used by the User for the initial transaction, unless the User has expressly provided otherwise; in any event, the User will not incur any charges as a result of the refund.

MAC AMBIENTS may withhold the refund until it has received the goods or until the User has provided proof of having returned them, whichever is the sooner.

 

The User shall return or hand over the goods directly to MAC AMBIENTS without undue delay and, in any event, within a maximum period of 14 calendar days from the date on which you inform MAC AMBIENTS of your decision to withdraw from the contract. The time limit shall be deemed to have been met if the User returns the goods before that time limit expires.

The User shall bear the direct cost of returning the goods.

The User shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

If the User has requested that the provision of services begin during the withdrawal period, they shall pay MAC AMBIENTS an amount proportional to the part of the service already provided at the time the User communicated their withdrawal, in relation to the total subject matter of the contract.

 

Exceptions to the right of withdrawal

 

In accordance with the provisions of Article 103 of Royal Legislative Decree 1/2007 of 16 November, approving the restated text of the General Law for the Defence of Consumers and Users and other complementary laws, the User may not withdraw from contracts concerning:

  1. The provision of services, once the service has been fully performed and, if the contract imposes a payment obligation on the User, when performance has begun with the User's prior express consent and with their acknowledgment that, once MAC AMBIENTS has fully performed the contract, they will have lost their right of withdrawal.

  2. The supply of goods made to the User's specifications or clearly personalised.

  3. The supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery.

  4. Contracts in which the User has specifically requested MAC AMBIENTS to visit them to carry out urgent repair or maintenance operations; if, during this visit, MAC AMBIENTS provides services in addition to those specifically requested by the User or supplies goods other than spare parts necessarily used to carry out the maintenance or repair operations, the right of withdrawal shall apply to these additional services or goods.

Complaints, claims and requests for information

The User may direct their complaints, claims and/or requests for information to MAC AMBIENTS using any of the following channels:

g) By calling 938833299 between 09.00 h and 14.00 h and from 15.00 h to 17.30 h, Monday to Thursday except public holidays, and from 08.00 h to 14.00 h on Fridays except public holidays.

 

Legal guarantee of conformity of goods

The User is reminded that, in accordance with the provisions of Articles 114 et seq. of Royal Legislative Decree 1/2007 of 16 November, approving the restated text of the General Law for the Defence of Consumers and Users and other complementary laws, all goods delivered or supplied by MAC AMBIENTS must comply with the concluded contract, with MAC AMBIENTS being liable to the User for any lack of conformity that exists at the time of delivery and which becomes apparent within a period of three years from that date.

Where applicable, the lack of conformity resulting from the incorrect installation of the goods shall be equated to the lack of conformity when any of the following conditions are met:

  1. The incorrect installation has been carried out by MAC AMBIENTS or under their responsibility and is included in the contract.

  2. the contract provides for the installation to be carried out by the User, it has been carried out by them, and the incorrect installation is due to deficiencies in the installation instructions provided by MAC AMBIENTS.

The scope and form of execution of the rights conferred on the User by this legal guarantee can be consulted in articles 114 and following of the aforementioned regulation.

 

Nullity and ineffectiveness of clauses

If any clause included in these General Conditions is declared totally or partially null or ineffective, such nullity or ineffectiveness shall affect only that provision or the part thereof that is null or ineffective, these General Conditions remaining in force in all other respects and such provision being considered totally or partially as not included.

 

7. EXCLUSION OF LIABILITY

The CONTROLLER declines any liability for information published on their website provided that this information has been manipulated or introduced by a third party external to the CONTROLLER.

 

Use of cookies

This website may use technical cookies (small files of information that the server sends to the computer of the person accessing the page) to carry out certain functions that are considered essential for the correct operation and visualisation of the site. The cookies used are, in any case, temporary in nature, with the sole purpose of making navigation more efficient, and disappear when the user's session ends. Nevertheless, and in compliance with the provisions of Articles 11 and 16 of the LSSICE [Spanish Law on Information Society Services and Electronic Commerce], it is made available to all users, authorities and security forces, actively collaborating in the removal or, where appropriate, blocking of all content that may affect or contravene national or international legislation, third-party rights or morality and public order. This website has been reviewed and tested to ensure it works correctly. In principle, correct operation can be guaranteed 365 days a year, 24 hours a day. However, the CONTROLLER does not rule out the possibility of certain programming errors occurring, or that causes of force majeure, natural disasters, strikes or similar circumstances may arise which make access to the website impossible.

 

IP addresses

The website's servers will be able to automatically detect the IP address and domain name used by the user. An IP address is a number automatically assigned to a computer when it connects to the Internet. 8. APPLICABLE LAW AND JURISDICTION

For the resolution of all disputes or issues related to this website or the activities carried out herein, Spanish legislation shall apply, to which the parties expressly submit, and the Courts and Tribunals closest to BARCELONA shall be competent for the resolution of all conflicts arising from or related to its use.
